98-year-old federal judge suspended — appeals to the Supreme Court.

The suspension of 98-year-old Judge Pauline Newman by colleagues highlights a notable legal dispute that could impact judicial independence and public trust.

Federal Judge Pauline Newman has appealed a suspension from the bench forced on her by her younger colleagues.

On September 20, 2023, Federal Circuit Chief Judge Kimberly Moore placed Judge Pauline Newman on suspension.

Chief Judge Moore claims that the senior jurist has become paranoid, and she’s refused to submit to a mental medical evaluation. Chief Judge Moore refused to assign Newman any case unless she takes the evaluations. So, there is a standoff.

Judge Newman’s decision to take her case to the Supreme Court underscores her determination to seek justice and uphold her reputation.

With the Supreme Court currently composed of six Republican and three Democratic judges, how will they rule?

The outcome could influence perceptions of judicial impartiality and fairness.

According to the American Bar Association (ABA), “Three years ago, Newman’s fellow judges at the U.S. Court of Appeals for the Federal Circuit prevented her from taking on new cases indefinitely.”

 

In February 1984, President Ronald Reagan appointed Ms. Newman to the federal circuit court.

The Constitution guarantees federal judges their position and salary for Life, unless they’re impeached by the House and convicted by the Senate.
Because the Constitution guarantees them the position for Life, some federal judges actually believe that means until death do they part from working the position.
In about three months, Judge Pauline Newman will turn 99 years old. The late President Ronald Reagan is looking around, wondering, where the hell is she? I thought she’d be here by now.
In 2020, Supreme Court Justice Ruth Bader Ginsburg died while sitting on the bench.

Ruth Bada Ginsburg was 87 years old and in extremely poor health. The Constitution guarantees them a lifetime position.   

In 1932, Oliver Wendell Holmes, Jr. retired as a justice of the SCOTUS. He was 90 years old. In 2010, when John Paul Stevens retired, he was also 90. After the Ruth Bader Ginsburg fiasco in 2022, Justice Stephen Breyer retired at age 83, making way for Ketanji Brown Jackson.

The “Great Dissenter.”

Among her colleagues, jurist Pauline Newman is known as the Great “Dissenter.” In other words, she has become a pain in their asses. They want her gone. Partisan politics and bribed money must make the decisions.

Although Chief Judge Kimberly Moore is a Republican, everybody takes a little something on the side. Is she stinking up the room when she comes to work?

If she doesn’t stink when she comes to work… She wakes up in the morning and washes her ass, she eats her breakfast, and shows up to work. At this stage in her Life, she is running on rote. She’s seen the similarities among the cases.

Philosopher George Carlin once said, “Life is not that complicated. You get up, you go to work. You eat three meals. You take one good shit, and you go back to bed.” That’s it. That’s what we do.

“Other judges who are watching what is happening to Judge Newman can only wonder if a similar fate will befall them if they fail to stay on the good side of their chief judge,” her petition reads.
